NOTE: MASSP does not initiate litigation on behalf of members, nor typically include in-person representation.
ADDITIONAL INFORMATION
In order to access these legal benefits, MASSP must be kept informed about any litigation involving a member even if such litigation is the responsibility of the board of education.
NASSP Provides …
Up to $1,000,000 for damages arising from professional liability and employment liability lawsuits for those at the Professional+ and Executive Level.
Up to $10,000 in legal expenses reimbursement if you are subject to a job-related due-process proceeding.
The plan protects against a broad range of exposures associated with your educational duties, such as:
- Injuries to students under your supervision
- Improper placement of students
- Hiring unqualified personnel
- Defamation
- Failure to educate, promote or grant credit to a student
- Violation of student civil rights
- Improper methods employed in instruction, counseling, research design, etc.
- Improper reassignment, demotion or termination of an employee
- Violation of an employee’s civil rights
Your District Provides …
Various levels of insurance to protect the district and those acting in roles as appointed.
Representation that will often cover you as an administrator performing assigned duties, but protection is not absolute.
Legal counsel to protect the interests of administrators when situations related to “defamation,” “libel,” or slander” occur, but the district is not obligated to do so.
It’s Not Personal
MASSP membership provides legal support associated with your educational duties, but it does not provide support for personal matters such as:
- Cases involving Defamation of Character (e.g.: libel and/or slander)
- Criminal Cases ( e.g.: CSC, drunk driving, etc.)
- Personal Legal Matters (e.g.: wills, trusts, divorce, etc.)
MASSP Member Eligibility
MASSP members are eligible for legal assistance based on the following scale:
- Membership < 6 months
(eligible for consultation with MASSP staff)
- Membership 6-24 months (eligible for up to $1,000 in legal services)
- Membership 25-60 months (eligible for up to $2,500 in legal services)
- Membership 61 months or more (eligible for up to $5,000 in legal services)
To receive legal assistance, the association member must:
- Be an active member in good standing at the time the alleged act occurred and is a member in good standing at the time a request for assistance is made. Further, membership must be maintained during the entire period that assistance is rendered.
- Have received approval for assistance from the MASSP Executive Director or his/her designee before being assigned or engaging legal counsel.
- Cooperate fully with the association and/or legal counsel in matters regarding his or her defense.
NASSP Member Eligibility
NASSP provides full legal benefits immediately upon the day you join.
Protection. Security. Reliability.
NASSP’s in-dues professional liability insurance program affords members peace of mind. The insurance policy provides professional liability coverage for claims filed against each eligible member of NASSP.
There are no premiums payable by members or their schools for this plan. It becomes effective the date your membership is accepted by NASSP and continues as long as you remain a member in good standing and NASSP continues to offer this professional liability plan with legal assistance benefits as an in-dues member benefit.
The National Association of Secondary School Principals’ in-dues professional liability plan is the solution to uncertain or inadequate liability coverage. You’ll have peace of mind knowing that if your school district doesn’t have sufficient coverage or refuses to defend you, your back-up plan is in place. Your association’s affiliation with the Association of Public & Private Educators (APPE) makes this valuable member benefit possible.
Membership Level Matters
Only those with Executive and Professional+ memberships include both MASSP and NASSP legal services. If you currently have a Professional Membership and would like to add NASSP membership ($250) or you are unsure of your membership level, please email sarah@michiganprincipals.org.
NOTE: Both MASSP & NASSP require membership at the time of the act or omission that results in a claim, when a claim is made, and continuously throughout a claims process.
